MPs in the National Assembly of Republika Srpska adopted the Declaration on the Closure of the Office of the High Representative, which requests that the function of the High Representative in BiH be ended and the OHR closed. This is an example of how we should function, stated Nenad Stevandić.

MPs of the National Assembly of Republika Srpska adopted the Declaration on the Closure of the OHR, on the proposal of the President of the Parliament Nenad Stevandić.

President of the National Assembly of Republika Srpska Nenad Stevandić assessed that it is extremely significant that the republic’s parliament adopted the Declaration on the Closure of the Office of the High Representative, which once again shows that Christian Schmidt is absolutely irrelevant for Srpska.

“I am extremely pleased that we had a two-thirds majority and that the stated act was harmonized. This is an example of how we should function,” stated Nenad Stevandić.

Stevandić expressed satisfaction that other acts important for Republika Srpska were adopted today.

57 MPs out of 60 present voted for the Declaration, which contains eight conclusions.

The Declaration, among other things, states that Christian Schmidt does not represent the international community in BiH, and has no right to perform functions within the competence of domestic authorities.

The Declaration demands the closure of the Office of the High Representative, the cessation of imposing decisions, and the return of competencies to domestic institutions in accordance with the Dayton Agreement.

The adopted document emphasizes that the National Assembly, as the highest body of Republika Srpska – a contracting party to Annex 10 of the Dayton Peace Agreement, requests the UN Security Council to urgently adopt a resolution ending the function of the High Representative in BiH and closing the OHR.

The National Assembly of Republika Srpska recalls that Annex 10 is an international treaty by which the contracting parties temporarily, under strictly defined conditions and a clearly defined goal, entrusted certain functions of domestic authorities to the international community, i.e., its High Representative in BiH.

The Declaration points out that during the application of this annex, a material breach of its provisions occurred by ignoring the will and not seeking the consent of the contracting parties in the procedures for appointing the High Representative, as well as by the extra-contractual and unlawful expansion of his powers through the so-called Bonn powers.

The bodies of Republika Srpska actively protest against this, and demand that all contracting parties urgently eliminate the consequences of legally null acts arising from their use.

The final and complete termination of the treaty regime established by Annex 10, which gave legitimacy to the OHR for the temporary and limited performance of functions within the competence of domestic authorities, occurred in 2021 when Christian Schmidt took office, contrary to the clearly expressed will of Republika Srpska and without the explicit confirmation of the UN Security Council, the Declaration states.

The adopted document emphasizes that Schmidt does not represent the international community in BiH, and has no right to perform functions within the competence of domestic authorities.
