The constitution of the National Assembly is the next step following the publication of the official parliamentary election results. Although the Republic Electoral Commission has still not published the official results, claims are increasingly appearing in former regime-aligned media that the Serbian Progressive Party can obstruct the formation of parliament. However, this is not true.

The misconception about the possibility of obstructing the formation of parliament stems from an incorrect interpretation of legal provisions stating that 167 mandates (two-thirds of the total number of seats) must be verified for the Assembly to be constituted.

However, it is not necessary for all 167 MPs to be present at the constitutive session in order for their mandates to be verified.

The constitution of the new composition of the Serbian Parliament involves several steps. First, the Republic Electoral Commission (RIK) adopts an overall report on the election results within 96 hours of receiving all consolidated reports. It then allocates mandates to parliamentary candidates through a formal decision within 10 days.

The constitutive session, which requires a quorum of 50 percent of MPs, is convened within 30 days of the announcement of the final election results.

The National Assembly is constituted once 167 mandates of future MPs have been verified, and the only requirement for verification is a quorum of 50 percent of MPs.

The misconception promoted by former pro-government media stems from the fact that the mandates are distributed in such a way that it is impossible for one side to hold all 167 seats. However, mandate verification is a technical procedure, not something that is put to a vote.

In other words, when more than 125 MPs from the Student List are present in the parliamentary chamber on the day of the constitutive session of the National Assembly, the mandate verification process can begin.

Mandates are verified in the order in which candidates are listed on the electoral list. Therefore, SNS candidates do not have to attend this session, and their mandates will still be verified.

Withdrawing mandates before verification is not permitted and is not even possible, given that mandate verification involves only checking the relevant documents.
