A single mother and her four children who have been living in Germany for six years will be deported to Serbia, German media report, after a German court rejected her request for the family to be granted asylum through an accelerated procedure.
The Administrative Court in Düsseldorf, in North Rhine–Westphalia, explained its ruling by stating that the mother is not well integrated into German society.
Earlier, schoolmates of her children launched a petition for the family to be allowed to stay. Media report that the children are active in local associations in the Kleve district, including a football club.
The court, however, determined that since the mother’s asylum request was rejected in 2019, there is no longer any reason for her and her children to be tolerated in Germany.
According to the court’s decision, she also does not have the right to invoke the European Convention on Human Rights and its provision guaranteeing respect for private and family life, because that requires a foreigner in Germany to be well integrated, to have social contacts, and to have practically become a citizen of the country.
The mother, the court assessed, does have certain social contacts in her place of residence, but she has not integrated well and therefore cannot request a residence permit on humanitarian grounds.
The court noted that she does not speak German and is unemployed, and that she has spent most of her life in Serbia, where she has family members who previously supported her and her children.
Children, as a rule, share the legal and factual fate of their parents, and therefore the children must also leave the country, even if they are active in society and in school, the court stated in its ruling, which is final.
