National Assembly of Republika Srpska issues conclusions on ruling against President Dodik and violation of the Constitution of Bosnia and Herzegovina
The National Assembly of Republika Srpska convened today and issued conclusions regarding the recent developments surrounding the verdict against the President of Republika Srpska, Milorad Dodik, and the alleged violation of the Constitution of Bosnia and Herzegovina.
The conclusions state:
REGARDING THE BRIEFING ON THE VIOLATION OF THE CONSTITUTION OF BOSNIA AND HERZEGOVINA – MEASURES AND TASKS FOR THE PRESERVATION OF THE CONSTITUTION OF BOSNIA AND HERZEGOVINA
- The National Assembly of Republika Srpska hereby adopts the Briefing on the violation of the Constitution of Bosnia and Herzegovina outlining the measures and tasks necessary for its preservation.
- The National Assembly of Republika Srpska notes that the Court of Bosnia and Herzegovina issued its ruling based on the decision of an unauthorized foreigner, Christian Schmidt, rather than on a law duly enacted by the Parliamentary Assembly of Bosnia and Herzegovina. By doing so, it committed an act of a coup d’état and a gravely undermined the constitutional order of Bosnia and Herzegovina. The National Assembly rejects and deems null and void all laws and decisions adopted on the basis of Christian Schmidt’s decisions.
- The National Assembly of Republika Srpska declares null and void all laws and decisions issued byinstitutionsthat do not derive their authority from the Constitution of Bosnia and Herzegovina, particularly those issued by the High Judicial and Prosecutorial Council, the Prosecutor’s Office of Bosnia and Herzegovina, the Court of Bosnia and Herzegovina, and the State Investigation and Protection Agency (SIPA).
- The National Assembly of Republika Srpska notes that the decision of the Court of Bosnia and Herzegovina was rendered on the basis of a decision imposed by a foreign national, contrary to the Constitution of Bosnia and Herzegovina, and as such, constitutes a breach of the constitutional order of Bosnia and Herzegovina.
- The National Assembly of Republika Srpska demands that the Attorney General’s Office of Republika Srpska file criminal charges against all prosecutors of the Prosecutor’s Office of Bosnia and Herzegovina and judges of the Court of Bosnia and Herzegovina who acted based said decision. The criminal report is to be submitted to the Prosecutor’s Office of the Federation of Bosnia and Herzegovina and the Prosecutor’s Office of Republika Srpska.
- The National Assembly of Republika Srpska mandates the Government of Republika Srpska to draft and submit to the National Assembly legislation that will prohibit the operation of bodiesthat lack legitimacy under theBiH Constitution within the territory of Republika Srpska. This specifically pertains to the High Judicial and Prosecutorial Council, the Court of Bosnia and Herzegovina, the Prosecutor’s Office of Bosnia and Herzegovina, and the State Investigation and Protection Agency.
- The National Assembly of Republika Srpska unequivocally condemns the actions of the Prosecutor’s Office of Bosnia and Herzegovina directed against members of the National Assembly of Republika Srpska for executing their official duties. These actions ultimately serve the purpose of intimidation and political suppression. The Assembly firmly opposes any measures undertaken by the Prosecutor’s Office of Bosnia and Herzegovina and other bodies acting under its directives against elected representatives of the people.
- These conclusions shall take effect immediately upon adoption.
