Spase and Slavica Rajić, parents of eight-year-old Žarko and eleven-year-old Nevena who were killed in an attack by Croatian aviation on a refugee column on Petrovačka cesta, have announced that they will appeal the verdict of the Zagreb Municipal Court which rejected their lawsuit against the Croatian state.
The reasoning in the verdict stated that the children were “war damage” with an order for the Rajićs to pay court costs of 8,000 euros. “The verdict, which we will appeal, took me back to the time when our children were killed. It brought me back to the bill and opened up unhealed wounds…

They were victims of war, from which they were escaping on their way to salvation,” Spase Rajić told “Večernje novosti”. The mother of the deceased children, Slavica, says that their children were murdered and announced that she would appeal as long as she is alive.
“Our murdered children are seeking justice, and we will seek it until God. Until heaven itself,” said the mother of the children, whose ashes were buried in the Apatin cemetery.

The director of the Documentation and Information Center “Veritas”, Savo Štrbac, explained that the parents sued Croatia for damages for the pain caused by the death of the children, and that the non-final judgment issued by the Municipal Court in Zagreb will be appealed. Namely, the court found that the children died as “war damage” for which Croatia is not responsible, and that the statute of limitations had expired, without explaining this position in detail and not correlating it with the procedures related to Petrovačka cesta, but simply listing them exhaustively.
“It is true that the statute of limitations is three or five years from the harmful event, but there is an exception if the damage was caused by a criminal offense. Since the criminal offense of war crimes does not expire, the claim for damages for that offense does not have to expire either,” explained Štrbac.
On Petrovačka cesta, in addition to Žarko (8) and Nevena (11), Jovica Drča (6) Darinka Drča (68), Mika Kovačević (83), father and son Krstan (45) and Darko (13) Vuković, father and son Branko (73) and Mirko (34) Stijelja, pregnant Mirjana Dubajić (21) were also killed, and several people were injured, of whom 15 were identified. On Prijedorska cesta near Svodna, Mile Malobabić (42) and Marta (60) and Rade Galogaža (40) were killed, while nine injured people were identified.
