The parents of the thirteen-year-old boy who, on October 5, 2023, killed his schoolmate Andrej Simić in his own home will soon find themselves in the defendants’ dock, as the Court of Appeal has legally upheld the indictment against both of them.

They are charged with the criminal offense of endangering public safety as co-perpetrators, for which a prison sentence of up to 12 years is prescribed, as well as with one criminal offense each of neglect and abuse of a minor, for which they may receive an additional three years of imprisonment each. Since he was only thirteen years old at the time of the crime, the killer boy cannot be criminally prosecuted.

Andrej’s father, Mića Simić, says he can hardly wait to enter the courtroom because, as he states, the only thing still keeping him alive is the desire for justice to reach those responsible for the death of his child.

“I am ready for the trial, I hope that the main hearing will be scheduled as soon as possible because all of this has been going on for far too long. Whether our agony had to last this long is a question for those who first became involved in this case. Whether it had to take 11 months for a decision to be made to prosecute the parents of the killer boy for failing to do anything to prevent the tragedy is a question for the people from the Basic Public Prosecutor’s Office in Niš who were handling this case at the time. I sincerely hope that proceedings will finally begin, which will not bring justice to me and my wife, because nothing will bring our Andrej back. However, if there is no justice, let at least the law be upheld, and that means imposing the maximum sentence on both the father and the mother of the child who killed my son,” the inconsolable father is adamant.

Asked what words he will address to the people he considers responsible for the greatest tragedy of his life, Simić says he will not yet utter those words.

“At this moment, I do not want to reveal what I will ask them. But I can hardly wait to hear what they have to say, although I believe that their behavior over these two and a half years has already said enough about who they are and what they are like. For two and a half years I have had no son, my life is nothing, and no one can change that, nor can any words bring comfort. What keeps me going is the desire to see this through to the end, because that is the least I can do for my Andrej. In that sense, I expect that the sentence imposed on these people will be a message to all parents not to sweep their children’s problems under the rug, because otherwise such monstrous acts will happen again. I repeat, this could have been prevented, my Andrej did not have to die. When I say this, I cannot ignore the failures of the school that my son and that boy attended. I will soon publish an official document that will prove what catastrophic failures were made and by whom, and I will seek an answer to the question of how those people are still allowed to work with children,” Simić announced.

Attorney Saša Knežević, legal representative of Andrej’s parents Mića and Sanja Simić, confirmed that the conditions have been met for the trial to begin.

“According to my information, the Court of Appeal in Niš rejected as unfounded the appeal filed by the defense counsel of the parents of the thirteen-year-old who killed Andrej, lodged against the decision confirming the indictment of the Higher Court. This means that the indictment has become final and that the conditions have been met for the trial to begin,” the attorney said.

In the indictment, the prosecution stated that the parents of the killed boy “in the period from July to October 5, 2023, in Niška Banja, made available cold weapons—knives suitable for inflicting injuries—throughout the house, within reach of their minor son, who exploited the easy accessibility of the knives and thereby endangered the life and body of the minor Andrej Simić.”

One of the key pieces of evidence against the parents of the minor killer are photographs taken before the crime showing the mother with a pistol and the boy “slitting” a teddy bear with a knife.

As we have learned, violent content was also found on his mobile phone, which likewise indicates that the boy posed a danger that his parents ignored.

Andrej was killed by his schoolmate with 37 stab wounds in the attic of his house in Niška Banja after he had invited him over to hang out. He then ran out into the street and threw himself to the ground, behaving completely irrationally, which is why he was treated by emergency medical services. He is currently in a psychiatric institution in Belgrade, and his parents have been issued a measure prohibiting communication with him. In addition, before the Basic Court in Niš, the Center for Social Work has initiated proceedings to strip them of parental rights.
