After yesterday’s verdict against Milorad Dodik in court, the Serbian member of the Presidency of Bosnia and Herzegovina, Željka Cvijanović, presented her views and the position of the Republika Srpska to her colleagues Denis Bećirović and Željko Komšić in the newly emerged situation.

- Mr. Christian Schmidt, the German politician who falsely claims to be the High Representative, is acting illegally and beyond any legitimate mandate, bringing Bosnia and Herzegovina to the brink of collapse, states the beginning of Cvijanović’s address, which continues:
- The most unbelievable and ruthless action by Mr. Schmidt was the unilateral imposition of a criminal law edict in July 2023, which actually threatened the imprisonment of all BiH officials who refused to treat his decisions as if they had been properly adopted by the legislative body of BiH.
- The democratically elected institutions of RS (National Assembly, Government, and President) rightfully refused to submit to this neocolonial practice. This defiance resulted in a politically motivated trial and the subsequent conviction of Mr. Milorad Dodik, the President of RS and one of the most prominent political figures in the region. The trial represents a potentially unprecedented destabilizing event in BiH since the 1992-1995 war.
- The actions of Christian Schmidt, supported by the prosecution and the politically driven decision of the Court to sentence the President of RS to one year in prison and impose a six-year ban on political engagement, have caused deep instability, injustice, and turmoil in RS, as well as in BiH as a whole. This obvious abuse of power stems from the long-standing misinterpretation of the High Representative’s mandate, which has led to the continuous violation of Bosnia and Herzegovina’s constitutional framework.
- In accordance with the principles of international law, RS supports the role of the High Representative strictly within the mandate granted to it by Annex 10 of the Dayton Peace Agreement. The executive powers allegedly granted to the High Representative by the Peace Implementation Council at the 1997 Bonn Conference were falsely, illegally, and unconstitutionally interpreted as having greater legal authority than the binding international treaty – the General Framework Agreement for Peace and its Annex 4. Such an illegal interpretation has led to the systematic violation of BiH’s constitutional framework and undermined its democratic governance.
- The OHR and its allies have initiated a series of judicial processes in Bosnia and Herzegovina that threaten to bring the country to a state of complete disintegration. It is completely unacceptable for the BiH Prosecutor’s Office to summon and investigate the MPs of the National Assembly of the Republic of Srpska – NSRS in connection with their parliamentary debate and voting. Equally unacceptable is the demand from the BiH Prosecutor’s Office for political parties to submit internal records and minutes from their meetings. These actions resemble authoritarian rule more than functional democratic governance.
- For years, various international representatives have falsely accused RS of undermining the Dayton Peace Agreement and seeking secession from BiH. In reality, RS has remained the main defender of the Dayton Peace Agreement, the BiH Constitution, as well as peace and stability in the country. It remains steadfast in its commitment to uphold these principles peacefully and solely within the framework of legitimate political actions.
- We are determined to restore the constitutional order on which BiH was originally founded and to annul the illegal changes imposed by successive High Representatives. This would provide BiH with a renewed opportunity for stability and prosperity. If this attempt fails, RS will have no choice but to declare the BiH Constitution defunct.
- RS remains committed to finding a peaceful and democratic solution to this impending catastrophe but is equally determined to defend its institutions and their constitutional rights by all necessary means.
- RS remains open to internal dialogue with all legitimate representatives of the other two constituent peoples in BiH and calls on all relevant parties to exercise restraint, maintain peace, and preserve stability, states the non-paper document of Željka Cvijanović, the member of the Presidency of BiH.
