The Pristina Constitutional Court has issued a temporary injunction prohibiting any activity by the central assembly, including the potential formation of a new government. This decision comes in response to a complaint from the Serb List against separate voting for the election of Assembly vice presidents from minority communities during the inaugural session.
The decision states that the temporary measure takes effect today and will last until September 30, 2025.
“By official duty and at the request of the applicants, a temporary measure is issued to prohibit any action by the elected members of the Assembly of Kosovo, as well as any procedure for the formation of the Government,” the statement from the constitutional court in Pristina says.
The Serb List announced that it had filed a complaint with the constitutional court against the separate voting for the election of two Assembly vice presidents from minority communities during the inaugural session.
In the separate vote, the candidate for the Bosniak, Turkish, Ashkali, Egyptian, and Gorani communities received the support of the Albanian parliamentary majority, while the nine members of the Serb List did not receive a single vote of support.
Nenad Rašić, a member of parliament outside of the Serb List, also did not get more than 56 votes, out of the required 61.
The Serb List challenged the separation of voting for vice presidential candidates from minority communities as unconstitutional.
Despite the non-election of a Serbian vice president from the Serbian community, Parliament Speaker Dimalj Baša declared the assembly constituted in its new session.
With its latest decision, the constitutional court in Pristina has sent a signal that the moves in constituting the new session of parliament were not in accordance with the constitution and valid acts and rules of procedure.
