The Higher Public Prosecutor’s Office in Belgrade has filed an indictment against Tatjana A.V. (55) due to the existence of reasonable suspicion that, in the period April/May 2021 at the Batajnica Covid hospital, acting as the hospital’s head and a pulmonologist, she applied an obviously inappropriate method of treatment and acted in an obviously negligent manner, thereby causing a deterioration in the health condition of the injured party B.M., as a result of which she died, while the accused lightly assumed that the stated consequence would not occur or that she would be able to prevent it, the statement says.
By the indictment, which was submitted to the Higher Court in Belgrade for a decision on confirmation, the accused is charged with the criminal offense of Serious offense against public health under Article 259 paragraph 2 in connection with Article 251 paragraph 1 of the Criminal Code, for which a prison sentence of 2 to 12 years is prescribed.
“There is reasonable suspicion that Tatjana A.V. on April 20, 2021 placed the injured party – who had been diagnosed with the Covid-19 virus on April 2, 2021 – in a semi-intensive care unit, although she should have been immediately admitted to the intensive care unit, as she met all the criteria for this, due to a malignant breast tumor and the presence of signs of respiratory insufficiency,” the statement says, adding:
“At the same time, the accused did not act in accordance with the then applicable Protocol 11 for the treatment of patients infected with the Covid-19 virus, which was in force in 2021, and thus the injured party was not prescribed an appropriate antiviral drug, although she met all the conditions for its application given the stage of the disease and laboratory findings, and the application of such a drug would have contributed to stopping further progression of the disease.”
She was prescribed an obviously inappropriate therapy, which led to a deterioration of the overall health condition of the injured party, as a result of which she died on May 3, 2021.
