A story that sounds like science fiction – except it is real and happening in Dalmatia. A certain entrepreneur built a morgue and tombs on someone else’s land and even attacked the crew of the show “Poziv” (The Call) from the Croatian television “Nova” when they asked him why he was doing it.
“Look, what you see here is my land where a morgue is located, built about a year and a half ago without my consent and without my approval, and to me, that is insane,” Joško Smoljić complains while walking toward the morgue.
The Mitlo cemetery in Dalmatia is located on plot 3032 and is owned by the Municipality of Marina. Right next to that plot are plots 3029/1, 3028/2, and 3028/1, which are owned by private individuals. And that is where the story begins. Someone poured concrete for 32 tombs and a morgue on private land, writes Dnevnik.hr.
Joško Smoljić explains: “We’ll start with this inheritance decision. It says that I inherited those disputed plots from my late grandmother Mara Smoljić. 3028/1, 3028/2. That is the land at the cemetery, at the cemetery in Mitlo. That is the land on which the morgue was built.”
The President of the Municipal Council, to whom he turned for help, remains taken aback by this undertaking.
“As far as I know, there is no project documentation or anything else for the execution, but only the communal utility company is allowed to receive money, not a private individual, as far as my information goes,” Mirjam Radić claims for Croatian TV Nova.

The Poziv crew went to the Marina communal utility company to see if they knew what was happening and who was building, where they spoke with the director Dragan Jakus:
“I am literally sick when people ask me questions about the expansion of the Mitlo cemetery. People got their tombs, they built them on a private plot, we have nothing further to do with it. As a communal company, we have absolutely nothing to do with it.”
As Dnevnik.hr states, journalists from Croatian TV Nova tried to talk to the entrepreneur behind the whole story, but everything escalated quickly, and after assaulting the “Poziv” cameramen, he issued a threat: “I’ll set the dog on you!”
The Director of the Directorate for Communal Economy, Tomislav Vukić, reacted sharply to the scandal with the illegal cemetery in the Municipality of Marina, emphasizing that private cemeteries on private land have not been legally possible in the Republic of Croatia for eight decades. According to current regulations, the right to use a burial site can only be granted by a local government unit or its communal utility company, while private construction firms have no authority to sell or charge for such sites.
Since no building permits for the expansion of the Mitlo cemetery were found in the Ministry’s records, Vukić announced an urgent inspection of the work of the local communal company to determine who allowed burials at the illegal location and based on which documents. Responsibility for this failure also lies with the Municipality itself, which was obliged to report the entire case to the construction inspection as soon as the works began, reports Dnevnik.
The fate of the built tombs and morgue remains extremely uncertain, because if an agreement on the purchase of the land and subsequent legalization is not reached, the structures face total removal. The final message from the Ministry to citizens is clear – the address for agreements on burial sites is exclusively the local government, not private entrepreneurs.
