Thousands of immigrants waiting to receive a green card in the United States will face various changes starting in August, depending on the type of application they have submitted. While some family-based categories are seeing progress, employment-based applicants continue to face a limited number of available immigrant visas.<\/p>\n\n\n\n
The U.S. Citizenship and Immigration Services (USCIS) has confirmed that family-based applicants will be able to use the more favorable schedule from the Visa Bulletin during August, while employment-based applicants must continue to rely on the stricter “Final Action Dates” schedule.<\/p>\n\n\n\n

The greatest progress has been made in the F2A category, which includes spouses and unmarried children under the age of 21 of U.S. lawful permanent residents. Progress has also been recorded in the F1, F2B, F3, and F4 categories, which may allow a larger number of applicants to submit documentation or receive decisions on previously filed applications, depending on their filing date and country of origin.<\/p>\n\n\n\n
The situation remains significantly more complicated for individuals seeking a green card through employment. During August, they will still be required to use the “Final Action Dates” schedule, which determines when an application can be finally approved.<\/p>\n\n\n\n
Although the August Visa Bulletin recorded limited progress in certain categories, the number of applications continues to exceed the available annual quotas. Among the most significant changes are the advancement of the EB-1 category for China, modest progress in the EB-3 category for most countries, while the EB-2 category for India and the EB-5 category (unreserved) for India remain unavailable.<\/p>\n\n\n\n
The U.S. Department of State has warned that, due to exceptionally high demand, the EB-1 category for India could become unavailable before the end of the fiscal year if the annual visa quota is exhausted.<\/p>\n\n\n\n
August is one of the final months of fiscal year 2026, which ends on September 30. As the end of the fiscal year approaches, the number of available immigrant visas decreases, meaning that some categories may once again retrogress or become temporarily unavailable until the beginning of the new fiscal year in October.<\/p>\n\n\n\n
Applicants will also face additional changes beginning on September 18, when a new rule from the U.S. Department of Homeland Security takes effect, changing the way officials assess whether an applicant could become dependent on public assistance.<\/p>\n\n\n\n
When making decisions, officers will be able to consider a broader range of factors, including age, health condition, family circumstances, financial resources, assets, debts, education, professional skills, and the financial sponsor’s affidavit.<\/p>\n\n\n\n
USCIS has also announced a new version of Form I-485, which is used to apply for adjustment of status to permanent residency.<\/p>\n\n\n\n
After September 18, older versions of the form will no longer be accepted, and all applicants will be required to use the updated edition when submitting their documentation.<\/p>\n\n\n\n
