The Mar\u0161 sa Drine movement announced today that, together with European organizations, it will file a lawsuit against the European Commission before the Court of Justice of the European Union (EU) after the Commission rejected a Request for Internal Review challenging the designation of the Jadar project as a strategic project.<\/p>\n\n\n\n
“This is not a symbolic move. It is a direct legal challenge to an EU decision that risks turning Europe’s green transition into a better-packaged version of global resource colonialism\u2014a model in which environmental law, human rights, and democratic consent are sacrificed in the name of ‘strategic interests,'” the movement said in a statement.<\/p>\n\n\n\n
Activist Bojana Novakovi\u0107 said that as the global race for critical raw materials intensifies and access to mineral resources is increasingly presented as a matter of strategic interest, Europe must not replace the old model of resource colonialism with its so-called “greener” version, while at the same time undermining the rule of law, environmental protection, and democratic accountability, the statement said.<\/p>\n\n\n\n
The Mar\u0161 sa Drine movement stressed that the case is important for everyone subject to the Critical Raw Materials Act (CRMA), adding that regardless of the outcome, it will establish a key legal precedent showing citizens, courts, companies, member states, and the European Commission itself how the judiciary interprets the CRMA and the criteria for declaring projects “strategic.”<\/p>\n\n\n\n
According to the movement, a victory would confirm that environmental and legal standards cannot be bypassed by invoking the CRMA, while a defeat would expose how the regulation is being used in practice to weaken environmental protection.<\/p>\n\n\n\n
In either case, the proceedings will shape the future legal framework for environmental protection and access to justice across Europe, making it one of the most significant cases for civil society, Mar\u0161 sa Drine said.<\/p>\n\n\n\n
