As <strong>Koha<\/strong> reports from the hearing &#8211; she pleaded not guilty.<\/p>\n\n\n\n<p>The prosecutor, <strong>Bekim Kodraliu<\/strong>, read the indictment, stating that <strong>J.\u0110.<\/strong> is charged with knowingly transmitting data, documents, and sensitive information to the <strong>Security-Information Agency of Serbia (BIA)<\/strong>, acquired during her official duties within the activities of the <strong>OSCE<\/strong> in <strong>Kosovo<\/strong>.<\/p>\n\n\n\n<p>At the same time, she is also charged with influencing <strong>OSCE<\/strong> reports, contributing to &#8220;the creation of a hostile narrative towards security institutions.&#8221;<\/p>\n\n\n\n<p><strong>Kodraliu<\/strong> stated that through these actions, <strong>J.\u0110.<\/strong> &#8220;seriously jeopardized the constitutional order and national security and put the life and security of state officials, citizens of the country, as well as the international staff of the <strong>OSCE Mission<\/strong> in <strong>Kosovo<\/strong>, in serious danger.&#8221;<\/p>\n\n\n\n<p>Lawyer <strong>Predrag Miljkovi\u0107<\/strong>, <strong>Koha<\/strong> reports, called on the court to consider house arrest, stating that all material evidence has already been provided to the prosecution, <strong>Kossev<\/strong> reports.<\/p>\n\n\n\n<p>The prosecution, however, pointed out that circumstances still exist that justify detention, including the risk of flight or reoffending. The president of the judicial panel, <strong>Rrahman Beqiri<\/strong>, announced that the decision on detention will be made outside of the main hearing.<\/p>\n\n\n\n<p><strong>J.\u0110.<\/strong> was arrested in <strong>February<\/strong> of this year.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p>Arrests for espionage<\/p>\n\n\n\n<p>There are an increasing number of proceedings in <strong>Kosovo<\/strong> being conducted for espionage, allegedly in favor of <strong>Serbia<\/strong>.<\/p>\n\n\n\n<p>One of them is being conducted against former <strong>Kosovo Police<\/strong> member <strong>Aleksandar Vlaji\u0107<\/strong>, who previously worked as a warehouse manager in the <strong>Serbian Ministry of Internal Affairs<\/strong> in <strong>Mitrovica<\/strong>. In <strong>June<\/strong>, he became the first person to be convicted of espionage by the <strong>Kosovo<\/strong> authorities. Media and court documents describe him as a <strong>BIA<\/strong> agent.<\/p>\n\n\n\n<p>Furthermore, by concluding a plea agreement, he was sentenced to five years in prison for the criminal offense of espionage, and was additionally fined &#8211; <strong>1,000 euros<\/strong> &#8211; for illegal possession of a weapon. Proceedings are still being conducted against him for another criminal offense &#8211; terrorism &#8211; on suspicion of throwing a bomb at the premises of the <strong>Municipal Election Commission<\/strong> in <strong>North Mitrovica<\/strong> in 2022.<\/p>\n\n\n\n<p>The <strong>Vlaji\u0107<\/strong> case opened the door for new arrests &#8211; based on the forensic analysis of even seven mobile phones he used. Among the suspects was <strong>J. \u0110.<\/strong> from <strong>Mitrovica<\/strong>, an <strong>OSCE<\/strong> employee, whom <strong>Vlaji\u0107<\/strong>, according to his own admission, recruited to provide him with confidential information and documents.<\/p>\n\n\n\n<p>According to the indictment of the <strong>Special Prosecutor&#8217;s Office<\/strong>, <strong>Vlaji\u0107<\/strong> communicated with <strong>J.\u0110.<\/strong> through seven different phone numbers that he regularly changed. He allegedly received sensitive data from her about the security and functioning of <strong>Kosovo<\/strong> institutions, including internal reports from meetings of the former head of the <strong>OSCE<\/strong> mission, <strong>Michael Davenport<\/strong>.<\/p>\n\n\n\n<p><strong>Pristina<\/strong> media state that he used a coded language &#8211; <strong>BIA<\/strong> was called &#8220;the firm,&#8221; and one message allegedly says that &#8220;at the <strong>BIA<\/strong>, they will get tired of reading the reports&#8221; he receives from <strong>J.\u0110.<\/strong>, adding that &#8220;he shouldn&#8217;t worry because someone is already handling it.&#8221;<\/p>\n\n\n\n<p>The <strong>Special Prosecutor&#8217;s Office<\/strong> claims that <strong>Vlaji\u0107<\/strong> had collaborators in other international organizations as well &#8211; the <strong>OSCE<\/strong>, <strong>EULEX<\/strong>, <strong>UNMIK<\/strong>, and <strong>KFOR<\/strong> &#8211; and that they were all members of the <strong>Serbian<\/strong> community. Along with <strong>J.\u0110.<\/strong> from the <strong>OSCE<\/strong>, the documents mention a person <strong>M.<\/strong> from <strong>EULEX<\/strong>, <strong>N.K.<\/strong> from <strong>UNMIK<\/strong>, and a person identified as <strong>N.64<\/strong> from <strong>KFOR<\/strong>.<\/p>\n\n\n\n<p>The indictment confirms that the information was forwarded to his superior at the <strong>BIA<\/strong> &#8211; a person with the initials <strong>R.G<\/strong>, stationed in <strong>Novi Pazar<\/strong>.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p>Uro\u0161evac: Two former customs officers among the suspects<\/p>\n\n\n\n<p>Last year on <strong>June 5<\/strong>, two <strong>Albanians<\/strong> were arrested in <strong>Uro\u0161evac<\/strong>, suspected of espionage for the <strong>BIA<\/strong>. One of them, <strong>B. Sh<\/strong>, is a former police officer from the nineties, who later worked as a customs officer during the <strong>UNMIK<\/strong> administration.<\/p>\n\n\n\n<p><strong>Kosovo Customs<\/strong> denied his connection to the institution, stating that he was discharged from duty back in <strong>2004<\/strong> for violating the <strong>Code of Conduct<\/strong>.<\/p>\n\n\n\n<p><strong>B.Sh.<\/strong> and <strong>M.Q.<\/strong> are accused of &#8220;collecting information of state importance&#8221; and about people in public office, which they then provided to <strong>BIA<\/strong> agents.<\/p>\n\n\n\n<p>At a hearing on <strong>July 15<\/strong>, both of them pleaded not guilty to espionage, while <strong>M.Q.<\/strong> admitted to illegal possession of a weapon.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p>Third Albanian suspected of espionage<\/p>\n\n\n\n<p>Another arrest followed on <strong>May 6<\/strong> &#8211; <strong>H.S.<\/strong> was arrested after a months-long investigation. The operation, as in previous cases, was led by the <strong>Kosovo Intelligence Agency<\/strong> in cooperation with the police and the prosecutor&#8217;s office. An indictment was filed against him on <strong>September 11<\/strong> for collaboration with the <strong>BIA<\/strong>.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p>Arrest of a police officer<\/p>\n\n\n\n<p>A new arrest for espionage occurred in mid-July. At that time, <strong>B.J.<\/strong> was arrested, otherwise a high-ranking <strong>Kosovo<\/strong> police officer of <strong>Serbian<\/strong> nationality, and he was employed in a border unit at the <strong>Bela Zemlja<\/strong> crossing, in the position of chief.<\/p>\n\n\n\n<p>According to the police, he also sent confidential information to the <strong>Serbian Security-Information Agency<\/strong>. Upon his arrest, a measure of detention was ordered.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p>Croatian soldier and a woman from Mitrovica<\/p>\n\n\n\n<p>The latest accusations of espionage, also allegedly in favor of official <strong>Belgrade<\/strong>, have caused a real stir in the region.<\/p>\n\n\n\n<p>It&#8217;s about the arrest of a couple &#8211; a <strong>Croatian<\/strong> pilot, a member of <strong>KFOR<\/strong>, and a <strong>Serb<\/strong> woman from <strong>Kosovska Mitrovica<\/strong>. They were arrested on one of the islands of the <strong>Split<\/strong> archipelago.<\/p>\n\n\n\n<p>Investigators allegedly found messages in their communication that indicated the transmission of confidential data about <strong>KFOR<\/strong>, <strong>Croatian<\/strong> media first reported.<\/p>\n\n\n\n<p>The pilot, it is claimed, sent information for three years which <strong>A. M.<\/strong> forwarded to the leaders of <strong>Srpska lista<\/strong> and one foreign journalist.<\/p>\n\n\n\n<p>The couple is also charged with revealing details about <strong>KFOR&#8217;s<\/strong> activities in <strong>Zubin Potok<\/strong> and the transport of former police officer <strong>Dejan Panti\u0107<\/strong>.<\/p>\n\n\n\n<p>Besides the <strong>Croatian<\/strong> authorities who initiated proceedings, judicial bodies in <strong>Pristina<\/strong> are also interested in the case.<\/p>\n\n\n\n<p>The <strong>Kosovo Special Prosecutor&#8217;s Office<\/strong> recently sent an official request to the authorities in <strong>Croatia<\/strong> for the submission of evidence, while the <strong>Kosovo Police<\/strong> searched the house of the <strong>Serb<\/strong> woman from <strong>Kosovska Mitrovica<\/strong>.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p>What does the law on espionage say?<\/p>\n\n\n\n<p>The criminal offense of espionage is regulated by <strong>Article 124<\/strong> of the <strong>Kosovo Criminal Code<\/strong> and covers seven paragraphs. The prescribed penalties range from a minimum of five years in prison, and in more severe cases can reach life imprisonment.<\/p>\n\n\n\n<p>Not all confidential data is automatically a state secret. For something to have that status, it must be so determined by law or by a decision of the competent state authority.
