A Norfolk County Superior Court judge rejected an attempt by Brian Walshe’s legal team to dismiss the most serious charge against him for the disappearance and alleged murder of his wife in Cohasset, Massachusetts.<\/em><\/strong><\/p>\n\n\n\n

Walshe’s request to dismiss the first-degree murder indictment was denied by Judge Diane Freniere in a decision issued on Tuesday.<\/p>\n\n\n\n

Defense attorneys, Larry Tipton and Kelly Porges, argued that the prosecution did not present enough evidence to support the first-degree murder indictment. However, Freniere concluded that the Commonwealth had indeed provided enough reasonable suspicion to justify the indictment. Walshe’s trial is scheduled for October, almost three years after Ana disappeared and was allegedly killed and dismembered.<\/p>\n\n\n\n

Walshe pleaded not guilty to the charges brought against him in connection with his wife’s disappearance.<\/p>\n\n\n\n
