The Constitutional Court of Montenegro has abolished Nikšić’s patron saint day – the Day of St. Basil of Ostrog, which was celebrated on May 12 and was introduced through amendments to the Statute of the municipality.

The amendments to the Statute, which introduced the city’s patron saint day, will cease to be valid on the day the decision of the Constitutional Court is published in the Official Gazette.

The decision to amend the Statute of the Municipality of Nikšić, which designated May 12 as the city’s saint day, was adopted at a session of the Municipal Assembly on April 27, 2023.

At the end of December last year, the Constitutional Court initiated a procedure to assess the constitutionality and legality of the decision to amend the Statute of the Municipality of Nikšić, ruling that the introduction of a city saint day required the approval of the Government of Montenegro.

The Court concluded that the Municipal Assembly of Nikšić did not adopt the decision in accordance with the procedure prescribed by law, specifically without obtaining government approval, thereby violating the principle of legality.

The Center for Democratic Transition stated that the Court’s decision prevented the undermining of the constitutional order and that they expect a full explanation of the ruling.

At the same time, the Constitutional Court, by majority vote, rejected the initiative to initiate proceedings for the assessment of the constitutionality and legality of Article 11 of the Decision on criteria, procedure, and selection of persons eligible to acquire Montenegrin citizenship by admission, for the implementation of a Special Investment Program of particular importance for the economic interests of Montenegro, reports the portal of Dan from Podgorica.
